U.S. Based Travel Accessories Company Upholds Evolution® Pillow Design Patent In Chinese Court<] Against The Well Known International Brand
LOS ANGELES, CA – Cabeau, a world leader in the travel products industry, was recently triumphant in its litigation against the Chinese license holder for the Jack & Jones brand, Bestseller Fashion Group (Tianjin) Co., Ltd. The suit involved Cabeau’s accusation that the global retail giant infringed on its intellectual property rights for Cabeau’s flagship product, the Evolution® Pillow.
The Intellectual Property Department at Cabeau discovered that Jack & Jones was selling a product that duplicated Cabeau’s world renowned Evolution® design, both in Chinese stores and in its online sales platform. Upon this discovery, Cabeau took swift legal action in filing a complaint in Chinese prefectural court. The final ruling in the case found that the pillow offered by Jack & Jones had significant similarities to the Evolution® Pillow, and would cause confusion to the general public.
The Court ordered Jack & Jones to pay monetary damages of a confidential amount to Cabeau and to immediately cease manufacturing, selling, and offering for sale the infringing product. As a result of the litigation, Jack & Jones has halted all manufacturing and sales of the contested pillow, and has chosen not to appeal the decision of the court. The decision is thus final and payment has been received from Jack & Jones.
The Cabeau brand is recognized for creating innovative travel products including compression socks, sleep masks, travel blankets, on-the-go gear and the award-winning memory foam Evolution® Pillow. The Evolution® Pillow has a patented design with 8 features, including 360° head and chin support and a compact travel bag.
“Cabeau offers unique and pioneering travel products that are of high caliber,” said Cabeau Founder & CEO, David Sternlight. “Due to the excellence and originality of the patented features of the Evolution® Pillow, and many of our other products, we take our intellectual property rights very seriously and work tirelessly to protect our award-winning designs.”
In honor of this commitment, the company devotes considerable resources to its Intellectual Property Department, which monitors and investigates products that violate the company’s intellectual property on a global scale.
